At SellerAfrica.com, we respect intellectual property rights and are committed to protecting the rights of content creators and owners. This Intellectual Property Protection policy outlines our approach to handling intellectual property concerns.

1. Reporting Intellectual Property Infringement

If you believe that your intellectual property rights have been violated on SellerAfrica.com, please contact us at support@sellerafrica.com with the following information:

  • A description of the intellectual property that you claim has been infringed.
  • A description of where the material that you claim is infringing is located on the site, with sufficient detail that we can find it.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the intellectual property owner or authorized to act on the owner’s behalf.
  • An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property interest.

2. Actions We May Take

Upon receipt of a proper notice of claimed infringement, we may:

  • Remove or disable access to the material that is claimed to be infringing.
  • Notify the content provider who is accused of infringement that we have removed or disabled access to the relevant material.
  • Terminate repeat infringers’ access to the site in appropriate circumstances.

3. Counter-Notice Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notice with us by providing the following information to support@sellerafrica.com:

  • A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district, or if your address is outside of the United States, for any judicial district in which SellerAfrica.com may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
  • Your physical or electronic signature.

If a counter-notice is received by our designated agent, we may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the intellectual property owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, at our discretion.

4. Repeat Infringer Policy

We have a policy of terminating, in appropriate circumstances and at our discretion, users who are deemed to be repeat infringers. We may also, at our discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
